Before the birth of their child, the mother arrived to the hospital with vaginal bleeding. She was immediately placed on a fetal monitor. An ultrasound was performed to try and rule out placental abruption. The attending nurse at the time, acknowledged that upon admission the fetal monitor strips did demonstrate average variability. The following morning there was a shift change in nurses. The day shift nurse noted that variability was now minimal to absent. Yet she did nothing to contact the physician. For the next several hours the fetal heart monitoring strips became more alarming, proving there were severe fetal problems. The baby was ultimately delivered by emergency C- section in an extremely depressed state. The child suffered severe neurologic injuries and severe mental retardation due to hypoxic ischemic encephalopathy. The family was later awarded over $9,000,000.00.
